At this point, it is crucial the EU and UK begin negotiating their new trade agreement. Delaying until after Brexit and relying on WTO rules in the meantime would cost the UK billions \u2013 in the best case scenario.<\/p>\n<p>The worst case would see trade conflicts erupting and negotiations with the rest of the world in indefinite limbo.<!--more--><\/p>\n<p>The much-heralded \u2018WTO option\u2019 &#8211; simply falling back on existing World Trade Organisation tariffs \u2013 is less like a safety net and more like running the gauntlet. Even if we were allowed to do this, which is far from guaranteed, it would be a very uncomfortable existence.<\/p>\n<p><img src=\"http:\/\/www.sussex.ac.uk\/wcm\/assets\/media\/531\/content\/42111.460x306.jpg\" alt=\"A photo of some delegates at a WTO conference\" \/><\/p>\n<p><em>The &#8216;WTO option&#8217; for British trading is &#8216;less like a safety net and more like running the gauntlet&#8217;.<br \/>\nPhoto courtesy of WTO (CC BY-SA 2.0)\u00a0<\/em><\/p>\n<p>In <a href=\"http:\/\/www.sussex.ac.uk\/eu\/articles\/brexit-hotel-california\">an earlier post<\/a> in this series, Professor Erika Szyszczak set out basic legal issues of withdrawing from the EU under Article 50 TEU to the tune of the Eagles\u2019 <i>Hotel California<\/i>.<\/p>\n<p>In counterpoint to the New Kids on the Block song <em>Step By Step<\/em>, here I show why the current proposal for post-Brexit trade negotiations would lead to a damaging breakup indeed.<\/p>\n<h3>What does the EU say?<\/h3>\n<h5>Or, Step 1: We can have lots of fun<\/h5>\n<p>Cecilia Malmstr\u00f6m, EU Trade Commissioner, <a href=\"http:\/\/www.bbc.co.uk\/news\/uk-politics-eu-referendum-36684876\">has stated<\/a> that the UK must first exit, then negotiate its trade agreement with the EU. In the interim, the UK and EU would trade under WTO rules. (In an <a href=\"http:\/\/www.cityam.com\/247468\/liam-foxs-new-government-department-just-issued-and-then\">erroneously-published press release<\/a>, International Trade Secretary Liam Fox echoed this view.)<\/p>\n<p><img src=\"http:\/\/www.sussex.ac.uk\/wcm\/assets\/media\/531\/content\/42110.460x305.jpg\" alt=\"A photo of Cecilia Malmstr\u00f6m, speaking from a podium\" \/><\/p>\n<p><em>Cecilia Malmstr\u00f6m,\u00a0EU Trade Commissioner,\u00a0has stated\u00a0that the UK must first exit,\u00a0<\/em><em>then negotiate its trade agreement with the EU.<\/em><\/p>\n<p>The basis for this position is that the EU has exclusive competence over common commercial policy, and EU countries must work together in\u00a0<a href=\"http:\/\/eur-lex.europa.eu\/legal-content\/EN\/ALL\/?uri=URISERV%3Al10125\">sincere and close cooperation<\/a>. If\u00a0<a href=\"https:\/\/www.socialeurope.eu\/2016\/07\/negotiating-trade-deals-brexit\/\">interpreted strictly<\/a>, this could mean that the EU can\u2019t negotiate even an informal trade deal with the UK while it is still a Member State.<\/p>\n<p>It is still unclear whether the EU will adopt Malmstr\u00f6m\u2019s position, but if it does, it would be very problematic for both the UK and the EU.<\/p>\n<h3>What does the law say?<\/h3>\n<h5>Or, Step 2: There\u2019s so much we can do<\/h5>\n<p>Determining the process by which the UK withdraws from the EU is an unprecedented problem, and trade negotiations fall into a grey area. This means the law can easily bend to the politics.<\/p>\n<p>Article 50 is vague and was <a href=\"http:\/\/www.reuters.com\/article\/us-britain-eu-amato-idUSKCN1012Q8\">never meant to be actually used<\/a>. Despite Malmstr\u00f6m\u2019s strong position, Article 50 does not prohibit EU-UK trade negotiations until after withdrawal. If anything it seems to encourage \u2018taking account of\u2019 these negotiations:<\/p>\n<p><em>\u2018The Union shall negotiate and conclude an agreement with that State, setting out the arrangements for its withdrawal, taking account of the framework for its future relationship with the Union.\u2019 (Article 50(2))<\/em><\/p>\n<p>Also, the EU could still maintain exclusive commercial competence, and cooperation with the UK, during Article 50 negotiations. The UK and EU can simply make clear that negotiation outcomes on a trade deal will not apply until <i>after<\/i> the UK formally withdraws.<\/p>\n<h3>Reasons not to delay<\/h3>\n<h5>Or, Step 3: It\u2019s just you and me<\/h5>\n<p>Postponing trade talks until after the UK has left the EU <a href=\"https:\/\/www.washingtonpost.com\/news\/monkey-cage\/wp\/2016\/07\/07\/delaying-brexit-will-be-costly-heres-why-britain-should-cut-the-cord-now\/?postshare=8081467883059121&amp;tid=ss_mail\">would dampen investment by drawing out uncertainty<\/a>, further rocking the economy and prolonging the EU\u2019s Brexit headache.<\/p>\n<p><img src=\"http:\/\/www.sussex.ac.uk\/wcm\/assets\/media\/531\/content\/42112.460x306.jpg\" alt=\"A photo of a stack of coins, with a clock in the background\" \/><\/p>\n<p><em>Postponing trade talks until after the UK has left the EU &#8216;would dampen investment by drawing out uncertainty&#8217;.\u00a0<\/em><\/p>\n<p>Also, it would make progress in withdrawing from the EU difficult. Imagine trying to discuss immigration reform, for example, without considering the UK\u2019s departure from the single market and what would replace it.<\/p>\n<p>Concluding negotiations is key to re-gaining global trade stability. Other countries need to understand the new EU-UK trade relationship before they can strike new trade deals with the UK.<\/p>\n<p>The UK\u2019s departure from the EU could even constitute grounds for countries to <a href=\"http:\/\/www.vanbaelbellis.com\/en\/fiches\/news\/news-year\/2016\/the-impact-of-brexit-on-eu-trade-relations.cfm\">re-negotiate or invalidate<\/a> existing Free Trade Agreements (\u2018FTAs\u2019) with the EU. The EU needs to settle its relationship with the UK as rapidly as possible to appease its trade partners.<\/p>\n<h3>Expecting too much of the WTO<\/h3>\n<h5>Or, Step 4: I can give you more<\/h5>\n<p>There is a deeper problem with Malmstr\u00f6m\u2019s statement: it assumes that WTO rules are a readily-available option in the awkward interim period when the UK has withdrawn from the EU but the new trade deal has not yet been concluded (which could <a href=\"https:\/\/www.gov.uk\/government\/uploads\/system\/uploads\/attachment_data\/file\/504216\/The_process_for_withdrawing_from_the_EU_print_ready.pdf\">take a decade<\/a>!)<\/p>\n<p>In the best case scenario, this is an expensive option. Take the example of cars: applying the EU\u2019s 10 per cent tariff to <a href=\"http:\/\/webarchive.nationalarchives.gov.uk\/20160105160709\/http:\/www.ons.gov.uk\/ons\/rel\/abs\/annual-business-survey\/car-production\/sty-car.html\">2014 exports<\/a> from the UK would cost well over a billion pounds. And the pain goes both ways: <a href=\"https:\/\/global.handelsblatt.com\/edition\/456\/ressort\/companies-markets\/article\/car-industry-would-bounce-back-experts-say\">one in three cars sold in the UK come from Germany<\/a>, and would face the same tariff.<\/p>\n<p><img src=\"http:\/\/www.sussex.ac.uk\/wcm\/assets\/media\/531\/content\/42113.460x345.jpg\" alt=\"A photo of a large multi-storey car park with many cars\" \/><\/p>\n<p><em>One in three cars sold in the UK come from Germany &#8211; and would\u00a0<\/em><em>face a higher tariff under the WTO option.<\/em><\/p>\n<p>In the worst case scenario, other countries could challenge the EU if it applied the same tariffs once the UK leaves.<\/p>\n<p>The WTO is not a monolith that assigns tariff rates, but a forum where countries negotiate.<\/p>\n<p>And there are other challenges, like disentangling the UK from EU quotas on agricultural imports.
